Last night 47-year-old Michelle Caves gave a shining example of why every state should enact “Hailey’s Law,” a law recently passed in Washington State that makes it impossible for drunk drivers to return to their car after being cited for DUI. Hailey’s Law lets police in Washington State call in to have a car towed after arresting a driver for driving intoxicated, but not only that, the driver isn’t allowed to go get their vehicle out of impound for 12 hours; hopefully sobering up during that time. Idaho unfortunately does not have a law like this in place. Michelle Caves was first spotted stumbling around a retail store where employees who noticed a strong smell of alcohol followed her into the parking lot and got a full description of her car as she drove away. Police tracked down Caves soon after and while attempting to pull her over she drove off the road and barely missed a concrete barrier. Her BAC was close to 4 times the legal limit. Caves was arrested and booked into jail but was released a few hours later. The first thing she did was return to her car so that she could continue her drunken drive home. Citizens reported the car and called police who determined that it was the same woman from earlier and took off to pull her over again. Her BAC was still over 3 times the legal limit.

Caves was again arrested, but this time police had her car towed to a private secure lot. As a Bellevue personal injury lawyer I think Caves actions were incredibly dangerous and she is very lucky that no one was hurt.

A Chevy Tahoe was driving eastbound on State Route 24 Friday morning, December 3^rd, at 6:30am when it crashed. The car was exceeding the speed limit when the driver, Catarino Balderrama from Yakima, lost control of the vehicle. Due to the excessive speed and bad weather conditions, the Tahoe rolled over on the road. Passenger Gregorio Mejia-Maldonaldo was ejected from the SUV and he was transported to Harborview Medical Center when paramedics arrived. Balderrama, the driver, was wearing a seatbelt and sustained no serious injuries.

While SUV’s like this Chevy Tahoe are much more likely to rollover in bad weather conditions, the danger of a vehicle rolling over is a threat to smaller passenger vehicles as well. Earlier today, a student and a pickup truck driver were killed in a multi-car crash 40 miles outside of St. Louis, Missouri. The accident happened when a pickup truck rear ended a semi-truck that slowed down before entering a construction zone. The crash became much worse very quickly as a school bus crashed into the back of the wreckage, before getting rear ended by a second school bus, which shot the first bus on top of the pickup truck. Along with the two tragic deaths that have been confirmed, at least 42 students were taken to the hospital, luckily it does not appear that the injuries they sustained are life-threatening. The students were on their way to Six Flags when the accident occurred, and the Superintendent of the school district has commented on how devastating this bus crash is to the community. It is not yet known if any of the driver’s involved will be charged.

Early yesterday morning on Whidbey Island, a 24-year-old woman rolled her car while driving northbound on Highway 20. The incident happened as the woman tried to illegally pass a car on the right-hand side of the road. Her car left the highway and rolled end over end – partially ejecting the woman during the process. She was stabilized and taken to Harborview Medical Hospital in Seattle, and does not appear to have any life-threatening injuries.

In an accident like this, I am very thankful that the woman did not suffer a worse consequence, as it could have easily been fatal. Driving on one-way highways can be frustrating to even the most patient drivers when you get stuck behind someone who is clearly driving below the speed limit. It is important in this situation to wait until the driver in front of you has an opportunity to pull over in a passing lane. There are also legal passes that you can make on straightaway portions of the road when it is clear. Passing a vehicle by going off the road is never legal and can lead to serious accidents such as the one in the news story above.
