Distracted driving, reckless driving and drunk driving contribute to a significant number of these fatal car accidents, but there are instances where an unsafe road is to blame and sometimes these can lead to fatal pedestrian accidents.

San Diego personal injury attorney Ross Jurewitz and the family of a victim to a fatal pedestrian accident has filed a lawsuit against the City of San Diego claiming an unsafe road took the life of Virginia Ortega. On March 18th, Ortega was struck by a tour bus as she crossed the intersection of West Harbor Drive and Pacific Highway in San Diego. The bus hit Ortega as it made a left hand turn –with the bus drivers seat position he could not see the pedestrian. The passenger on the bus yelled “stop” when the accident occurred sending the bus driver out of the bus where he attempted to perform CPR on the victim. Ortega was taken to a local hospital- but a few hours later died during an emergency surgery.

According to the lawsuit, Ortega’s fatal pedestrian accident was preceded by at least two other pedestrian accidents at the same intersection. The lawsuit wants the City to recognize the intersections dangerous pattern and take the necessary action to address the roadways inherent danger.
